Distance Selling Contract

The Distance Selling Contract for the services of a 360-degree advertising agency, graphic design, and advertising design offered by Rafine through the website www.rafine.ch is established under the following terms and conditions.

1. Parties

This contract is concluded between Rafine, represented by MSP Group, Lerzenstrasse 8, 8953 Dietikon, Switzerland (hereinafter referred to as “Service Provider”), and the Customer (hereinafter referred to as “Customer”). The Customer places an order through the website www.rafine.ch.

2. Subject of the Contract

This contract aims to define the rights and obligations of the parties regarding the order of services provided by a 360-degree advertising agency, graphic design, and advertising design, placed by the Customer via the website www.rafine.ch.

3. Description of Services

The services provided include 360-degree advertising agency services, graphic design, and advertising design, which are customized according to the specific needs of the Customer. These services are provided by the Service Provider and tailored to the Customer’s requirements.

4. Price and Payment Terms

•  The price for the services is displayed on the website www.rafine.ch.

•  The Customer agrees to pay the agreed price in accordance with the payment terms indicated on the website. The Service Provider is not obligated to deliver the services before full payment is received.

5. Service Delivery

•  The execution of the services begins after the Customer’s requirements have been clarified and the order has been confirmed.

•  Services will be delivered electronically after approval by the Customer.

6. Right of Withdrawal

•  The Customer has the right to withdraw their order before the Service Provider has started delivering the services.

•  Once the service provision has begun, the right of withdrawal no longer applies.

•  Any withdrawal must be notified to the Service Provider in writing via email or phone.

7. Cancellation and Return Policy

•  The Customer may cancel their order before the service delivery begins. Cancellation requests must be made in writing.

•  As the services are personalized for the Customer, no cancellation or return is possible after the service has been completed.

8. Customer’s Obligations

•  The Customer agrees to provide the Service Provider with all necessary information and materials in a timely and complete manner to allow the proper execution of the services.

•  The Customer is responsible for actively collaborating during the service delivery.

9. Service Provider’s Obligations

•  The Service Provider undertakes to deliver the requested services in accordance with the agreed quality standards during the contract period.

•  The Service Provider guarantees that the Customer’s data will be treated confidentially, in compliance with the Swiss Data Protection Act (FADP), and will not be shared with third parties.

10. Applicable Law and Jurisdiction

For any disputes arising from this contract, Swiss law applies, and the competent court is located in Dietikon, Switzerland.

11. Effective Date

This contract comes into effect as soon as the Customer places an order for services on the website www.rafine.ch and confirms the order.

This distance selling contract complies with Swiss regulations, including the Federal Act on Data Protection (FADP) and the relevant provisions for distance selling.
